Terms and Conditions
These terms and conditions govern the relationship between Centre Philae and its patients with respect to all physiotherapy, traditional massage, and wellness services.
1. Scope
In these Terms and Conditions (hereinafter “T&C”), the term “Centre Philae” refers to the sole proprietorship operated by Solen Duclos, which conducts its business under the registered trademark Centre Philae. The term “patient” refers to any person who requests or receives a service from Centre Philae, whether it be physical therapy, ASCA/RME-certified classical massage, or wellness treatments (LPG, Thecartherapy, etc.).
These Terms and Conditions apply in the version in effect at the time of service. Unless otherwise specified in writing, they exclusively govern the contractual relationship. Making an appointment—online, by phone, or in person—constitutes acceptance of these Terms and Conditions.
2. Services Offered
Services covered by the LAMal
Physical therapy sessions are covered by mandatory health insurance (LAMal) upon a doctor’s prescription, within the limits of the current list of covered services. Billing is handled through direct billing to the insurer. The deductible and copayment remain the patient’s responsibility, in accordance with the terms of their insurance policy.
Services not covered by the KVG
Classic massage services (recognized by ASCA and RME) and wellness treatments (LPG Endermologie, Thecartherapy, etc.) are not covered by the LAMal. Depending on your supplemental insurance policy, partial or full reimbursement may be available through ASCA and RME accreditation. It is the patient’s responsibility to verify their coverage with their insurer.
These services are paid for at the time of the session via TWINT or in cash.
3. Appointments and Cancellations
Appointments are non-refundable: the time slot is specifically reserved for you. In case of unforeseen circumstances, please notify the office at least 24 hours in advance.
In the event of a late cancellation or a no-show without prior notice, a fee of CHF 60 may be charged to the patient as compensation (Art. 404(2) of the Swiss Code of Obligations), unless there is a valid reason (illness, accident, emergency) or the appointment slot has been rescheduled.
4. Payment Processing
Payment Terms
Invoices issued to private individuals are payable within 30 days of the invoice date. Any services not covered by health insurance or supplemental insurance remain the patient’s responsibility.
We encourage patients to check their insurance coverage before their appointments to find out which services are actually covered.
Late payment
In the event of non-payment by the due date, the following charges apply, in accordance withArticle 104 et seq. of the Swiss Code of Obligations:
If payment is not made after the third reminder, the case is referred to a collection agency or the competent debt enforcement office. Default interest of 5% per year may be charged as of the date of the formal notice (Art. 104 CO).
We always prefer to resolve matters amicably and encourage patients facing financial difficulties to contact us to work out a payment plan.
5. Packages and prepaid services
Certain wellness services (LPG, Thecartherapy, classic massage) may be offered as prepaid packages. Unless otherwise expressly agreed, purchased packages are:
- non-refundable, including partial refunds;
- They are registered in the holder's name and cannot be transferred to another person;
- may be used indefinitely, within the scope of the Philae Center's activities.
Sessions included in a package remain subject to the cancellation terms set forth in Section 3 of these Terms and Conditions: a late cancellation or a no-show without a valid reason will result in the session in question being considered used.
6. Nature and scope of services
The treatments provided adhere to generally accepted standards of physical therapy, classical massage, and wellness care. The practitioners at the Philae Center keep their skills up to date in accordance with their continuing education requirements (LPSan and the Physioswiss Code of Ethics).
As with any therapeutic treatment, individual responses to treatment may vary depending on physical condition, overall health, and adherence to recommendations. No guarantees of results can be made.
7. Data Protection
The Philae Center processes patients’ personal data in strict compliance with the nLPD and professional confidentiality. The terms of processing, the third-party service providers involved in billing and appointment management, as well as your rights, are detailed in our privacy policy.
By scheduling an appointment, the patient confirms that they have read and understood this policy.
8. Jurisdiction and Governing Law
These Terms and Conditions are governed by Swiss law, excluding conflict-of-laws rules. The competent court for any dispute is in Lausanne, Canton of Vaud, subject to any appeal to the Federal Supreme Court.
9. Final Provisions
The Philae Center reserves the right to modify these Terms and Conditions at any time. The current version is available at centre-philae.ch/conditions-generales-de-vente and takes effect upon publication.
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a legally valid provision that most closely reflects the original intent.
