Terms and conditions of sale

Field of application

In these General Terms and Conditions of Sale (hereinafter referred to as "GTCS"), the term "Centre Philae" refers to the sole proprietorship managed by Solen Duclos, which operates under the registered trademark Centre Philae. The term 'patient' refers to any person seeking or receiving treatment under the Centre Philae trademark, whether for physiotherapy or any other service offered by Centre Philae. This definition includes, but is not limited to, individuals who make an appointment, consult or enter into a contractual relationship with Centre Philae in order to benefit from its services.

These terms and conditions define and govern the commercial relationship between Centre Philae and the patient. They apply in their current version at the time of treatment. Unless explicitly agreed otherwise in writing, these GTC govern exclusively the business relationship relating to the treatment specifically agreed.

Data protection

  • Consent to privacy policy: By booking an appointment via our website agenda.ch, or by telephone, the patient confirms that he/she has read our Data Protection Policy, which can be accessed here, and expressly accepts the terms of this policy.
  • Ownership of and access to patient records: Patient records remain the property of the patient and are accessible upon request at any time. Center Philae retains these records for the purposes of treatment management, billing and collection. This information is accessible only to authorized Centre Philae employees.
  • Data transmission : For billing and appointment management purposes, the necessary data is shared with specific third parties such as medionline.ch, agenda.ch, and the patient's health insurance company. This data is transmitted in compliance with legal obligations concerning confidentiality and data security.
  • Exchange of medical data: Unless explicitly opposed by the patient, and in accordance with the necessities of medical treatment as permitted by applicable legislation, we exchange medical data and other relevant information with attending or prescribing physicians, as well as with the medical advisors of paying organizations and insurance companies. This exchange is carried out exclusively for the medical and administrative purposes necessary to manage the patient's treatment.
  • Patients' rights: In accordance with current legislation, patients have the right to request access, rectification and deletion of their personal data. To exercise these rights, or if you have any questions concerning the management of your personal data, please contact info@centre-philae.ch.

Cancellation policy

  • Booking and cancellation policy: Appointments booked with Centre Philae are considered firm. The time slot is specifically allocated and reserved for the patient. We understand that unforeseen circumstances may arise and, in such cases, ask the patient to inform the practice at least 24 hours in advance if it is necessary to cancel or reschedule the appointment.
  • Late cancellation fee: If the appointment is cancelled or changed less than 24 hours before the scheduled time, or in the event of absence without notice, a cancellation fee of CHF 60.00 will be charged directly to the patient. This measure is intended to cover part of the costs associated with time booked but not used.

Payment settlement

  • Standard payment terms: Privately invoiced treatment costs must be paid by the patient within 30 days of the invoice date. This is essential to ensure efficient management of the services provided.
  • Responsibility for costs not covered: All treatment costs not covered by insurance or health insurance must be paid in full by the patient. We encourage patients to check their insurance coverage in advance to understand which benefits are covered.
  • Late payment charges :
    • An initial reminder will be sent if payment is not received by the due date, incurring an additional charge of CHF 15.
    • A second reminder follows if the payment remains unpaid, with an additional charge of CHF 30.
    • If payment remains outstanding after two reminders, the file is transferred to a collection agency, and a fee of CHF 50 is added to the amount due.
  • Collection procedures: We prefer to resolve payment situations amicably and encourage our patients to contact us in the event of financial difficulties. However, for accounts in arrears, we are obliged to follow these procedures to maintain our ability to provide quality services.

Treatment

  • Treatment principles : The treatments provided to the patient conform to the generally recognized and well-known methods of physiotherapy and medical massage therapy. Our practitioners are committed to keeping their skills up to date with the latest advances in their field.
  • Nature and effectiveness of treatment: We are committed to providing the best possible care for our patients. However, as with any medical or therapeutic treatment, individual response to therapy may vary, and complete success cannot be guaranteed. Each patient reacts differently, depending on a variety of factors such as physical condition, pre-existing medical conditions, and adherence to treatment recommendations.

Jurisdiction and applicable law

The place of jurisdiction for all disputes arising out of or in connection with this contract is Lausanne, Switzerland. The applicable law is exclusively Swiss law, to the exclusion of conflict-of-laws rules.

Final provisions

Center Philae reserves the right to modify these GTC at any time. The version currently in force can be consulted on our website at www.centre-philae.ch/cgv. The modified version comes into force as soon as it is published on the website.

Should any provision of these General Terms and Conditions be invalid or unenforceable, this shall not affect the validity of the remaining provisions. Invalid points are to be replaced by the statutory provisions, if any.
